​President Donald Trump threatens to bench Todd Blanche from his formal confirmation process to lead the Department of Justice, suggesting he could temporarily withdraw the attorney general nomination until Republican holdouts vacate their Senate seats.

​The decision comes after the Senate Judiciary Committee postponed a scheduled vote on Blanche’s nomination. Senators John Cornyn of Texas and Thom Tillis of North Carolina signaled they would vote no over unresolved concerns surrounding a recent Justice Department tax settlement. With a razor-thin majority, a single Republican defection in committee is enough to block the nomination from reaching the Senate floor.

Why Cornyn and Tillis Are Blocking the Nomination

​The standoff centers on President Trump’s lawsuit settlement with the Internal Revenue Service. Both Cornyn and Tillis have demanded formal written guarantees regarding two specific elements of the deal. Lawmakers want binding assurances that the DOJ’s proposed $1.776 billion compensation fund will remain permanently dead. Senators are pushing to narrow provisions that shield the president, his family, and his business entities from future tax audits.

​As Donald Trump threatens to bench Todd Blanche to bypass opposition, the administration is choosing political maneuvering over proper legislative oversight. Side-stepping the advice and consent process by keeping Blanche as “acting” head of the Justice Department sets a concerning precedent for executive power.

​ Rather than waiting for senators to leave office, the administration should address legitimate concerns about audit protections and public funds in writing to ensure standard constitutional checks remain intact.

​What Happens Next for the Attorney General Nomination?

​As Trump threatens to bench Todd Blanche until new senators take office in January, the White House faces real political risks. Postponing confirmation until 2027 leaves the nomination vulnerable to changes in the Senate majority following the upcoming midterm elections.

​Senator Cornyn warned that concerns over the IRS settlement extend beyond himself and Tillis, meaning other Senate Republicans could block the nomination next year.

​For now, Blanche will continue serving as Acting Attorney General while negotiations over the settlement text remain stalled.
