The former Eagles running back was released in order to spend the last weeks of his dying eight-year-old daughter’s life with her.
According to Gloucester County Superior Court Judge Renard Scott, a motion was granted on August 7 to allow him to withdraw a guilty plea made in a firearm case, a move which cleared the way for his release.
Eight-year-old daughter Mila was diagnosed with a rare, aggressive childhood cancer of the kidney called diffuse anaplastic Wilms tumor earlier this year, and after treatments failed, has been taken to hospice, where she reportedly has only weeks to live.
This latest court case is a more recent example, although Smallwood, the former Eagles running back now 32, was serving concurrent federal (18 months) for wire fraud, conspiracy, and tax fraud surrounding the misuse of federal relief programs, which he pleaded guilty to in March 2022.
He received three years for unlawful possession of an assault firearm in March 2023. But this August ruling was strengthened by a July 3rd circuit court decision which ruled the state’s ban on assault firearms unconstitutional.
With his daughter so ill, the judge ruled Smallwood’s case could be taken under review, and his decision was considered a major factor.
He had a career with the Eagles, Washington Commanders and Pittsburgh Steelers.
