Punishment for the offense of Rape is different in each jurisdiction depending on the act that is adopted in each state, a man named Stephen Francis has been given a life imprisonment sentence by the Ikeja Sexual Offences and Domestic Violence Court, for having unlawful carnal knowledge of a primary five pupil in his room, who according to Nigerian law is still a major-minor.
According to Justice Abiola Soladoye who is the presiding judge, the accused was guiltily owing the prosecution’s ability to prove the three ingredients of rape against the accused.
She also said, the 11year old victim confidently pointed out the accused from the dick as the man who raped her as he lied to her that his wife was calling her. He took her to his house and had sexual intercourse with her without her consent, the victim reported to her mother immediately.
The judge also said that Penetration no matter how slight will suffice
So according to all the evidence submitted the defendant was found guilty of rape and was sentenced to life imprisonment. The judge further held that his name should be registered in the sexual offense register as maintained by Lagos State.
Soladoye said, “The survivor, an 11-year-old primary five pupil, identified the defendant in the dock as the man who sexually defiled her when he told her that his wife was calling her to run an errand for her.
“The defendant took her to his house and had sex with her. She said, ‘he took me to his room and slept with me. I went to my mother and reported it to her after that we went to the police station.
“The survivor’s testimony was consistent and unshaken under cross-examination…The defendant stripped her naked and had unlawful sexual intercourse with her.”
“I hereby find the defendant guilty as charged of the one count of defilement and he is hereby sentenced to life imprisonment, the judge ruled.
Soladoye added, “The defendant should have his name registered in the sexual offense register as maintained by Lagos State.”
