Tribunal Delays Judgment in Labour Party’s Appeal Against Governor Mbah

The Enugu State Governorship Election Petitions Tribunal, has withheld judgment on the petitions challenging the voting in of Governor Peter Mbah after political parties in the matter acceded their written addresses.

During the resumed proceeding, Justice Akano who headed the panel, delayed judgment on a date, that would be duly communicated to the concerned parties.

Chijioke Edeoga, the LP candidate is challenging the declaration of PDP’s Peter Mbah as the validly elected governor by the Independent National Electoral Commission, INEC in the March 18 governorship elections held in the State.

The petitioners: Edeoga and Labour Party had appeared in court, but the second respondent: Peter Mbah was represented by his counsels.

INEC is the first respondent in the appeal, and Dr Mbah and PDP are noted as the second and third respondents. 

Chief Adegboyega Awomolo, SAN, the head counsel to the governorship candidate of Labour Party and the political party itself had asked the tribunal to postpone the position of his clients and grant the petition sought after by his client.

He had said it because it had been established beyond reasonable doubt that Mr Mbah, as at the time of the election, had not constitutionally been qualified to contest for the election on the grounds of having presented a forged certificate of national service (NYSC) to INEC.

Chief Adegboyega Awomolo had also listed the issues of over-voting, non BVAS use, and purported forgery of NYSC certificate, among several issues, brought by the petitioner as to the reasons why the matter should be decided in favour of his client, Mr Edeoga.
