Justice Nyako To Withdraw From Nnamdi Kanu’s Trial

Justice Binta Nyako from the Federal High Court Abuja has announced that she is going to “rescue” herself from Nnamdi Kanu’s case.

She had made the declaration after Kanu asked her to rescue herself from his case since she had declined to obey the Supreme Court’s order, adding that he had lost confidence in the court.

Kanu had spoken out at the open court during the resumption of his trial on Tuesday. Afterwards, Justice Binta Nyako replied that she would be happy to recuse herself from the trial, and had no problem with his request, adding that she would be sending the case file back to the chief judge for a reassignment and further actions.

Kanu then vehemently ordered his counsel, Alloy Ejimakor to sit down while he stood up from the dock to address Justice Nyako.

He based his remarks on the Supreme Court’s decision which questioned the jurisdiction of where the reported broadcast that the federal court was charging him on was made.

What They’re Saying

“Sit down! I say you should sit down!” Kanu had yelled at his lawyer.

Speaking further, he said, “My lord, I have no confidence in this court any more, and I ask you to recuse yourself because you did not abide by the decision of the Supreme Court.

“I can understand it if the DSS refuses to obey a court order, but for this court to refuse to obey an order of the Supreme Court is regrettable.
“I am asking you to recuse yourself from this case.”

He also read a part of the judgment of the Supreme Court, where alleged bias against Justice Nyako was raised.

Meanwhile, the counsel for the Federal Government, Adegboyega Awomolo, had previously told the court that he was ready for the start of trial, but that it could not hold under the current circumstance.

Awomolo, however, tried to urge Justice Nyako to go ahead with the trial, but she responded that she had been told to recuse herself from the case.

“I hereby recuse myself and remit the case file back to the Chief Judge,” she announced.
