Philadelphia District Attorney Larry Krasner is taking a stand, filing a lawsuit against Elon Musk and his America PAC on Monday over Musk’s eye-catching $1 million registered voter giveaway. Krasner claims Musk’s giveaway is “an illegal lottery scheme” in Pennsylvania, where lotteries must be regulated by the state. According to the lawsuit, Musk’s plan to give away $1 million each day to registered voters violates this rule.

The Case for an Immediate Halt

The district attorney is demanding an emergency injunction to stop Musk, calling the giveaway a “scheme to influence voters.” The lawsuit points out that this isn’t about vote buying but rather about the legality of running an unregulated lottery. Krasner argues that Musk and his PAC are misleading participants by not sharing clear details on how winners are chosen or how personal data is protected.

Musk Doubles Down on His Giveaway

Despite the lawsuit, Musk announced the eighth $1 million winner in Lancaster, Pennsylvania, on Saturday and reiterated his intention to continue the giveaways to registered swing-state voters. Musk insists that signing his petition to support the First and Second Amendments is all participants need to do, adding that voting isn’t required — though it would be “nice.” Musk has stated, “We’re giving out a million dollars every day through Nov. 5. Just sign the petition, and you’re in.”

A Growing Debate Over Voter Influence

While Musk claims the giveaway promotes constitutional rights, federal law prohibits anyone from offering payment to encourage voter registration or voting. The potential penalty for breaking this law includes fines and even jail time.

America PAC, Musk’s super PAC, seemed unfazed, pointing to a post on X announcing Monday’s winner after the lawsuit news broke. The recent winner, based in Michigan, hints that Musk intends to keep the giveaways rolling. However, the lawsuit alleges that Musk’s PAC hasn’t fully disclosed how the lottery operates, with accusations that winners may not be randomly chosen — two winners reportedly lived close to Musk’s rallies and attended his events.

“A Threat to Free and Fair Elections”

Krasner warns that without intervention, Musk’s lottery scheme could harm Philadelphia residents and undermine the integrity of a fair election. By presenting his case against Musk, Krasner is challenging what he sees as a deceptive influence on voters and a potential threat to the public’s trust in the electoral process.
