Florida Lawmaker Randy Fine is introducing a tough bill that demands harsh penalties for birth tourists who enter the country to give birth. The new legislation comes after the U.S. Supreme Court upheld birthright citizenship under the 14th Amendment. Since the court decision limits direct changes to citizenship rules, Fine wants to target the parents directly. His proposed plan would impose 10 to 25 years in prison for non-citizens who enter the United States with the primary intent of securing an American passport for their child.

Under the draft legislation, entering the country or hiding true travel intentions to deliver a baby would become a major federal crime. Fine argues that wealthy foreigners and international travel groups use American medical services to get around standard visa laws. While the child would still receive citizenship under constitutional law, the parents would face mandatory prison terms followed by immediate deportation.

Fine claims that these birth trips create huge costs for American taxpayers who end up funding hospital bills and local social services. The bill aims to make the legal risk so high that foreign families will stop treating American birthright as an open business opportunity.

My Opinion

This proposal hits on a real issue that bothers many voters, but its solution goes way too far and creates much bigger problems.

Birth tourism is a real business practice that needs better enforcement. Foreign companies market expensive travel trips to pregnant women so their children get instant citizenship, access to public schools, and a future path to bring family members over. It undermines people who wait for years in line to immigrate legally.

However, locking parents up for up to 25 years in federal prison is an extreme reaction. Think about what that actually means in practice. You end up with a newborn baby who is an American citizen by law, while the mother is locked inside a federal penitentiary for decades. Who takes care of that child during that long prison term? American taxpayers would pay tens of thousands of dollars each year to incarcerate the parent, and local foster systems would have to raise the kid. That ends up costing taxpayers far more money than the hospital bill ever did.

Instead of creating massive long-term prison sentences, the federal government should focus on practical solutions. Consular officers should check tourist visa applications more closely, and federal agents should shut down the commercial networks that profit from arranging these birth trips in major cities. Banning fraudulent visitors and fining commercial operators works much better than creating decades-long prison sentences for families.

Bottom Line

The proposal faces long legal and political battles as Congress debates the push for harsh penalties for birth tourists. While conservative lawmakers want to shut down birthright loopholes, critics argue the harsh prison terms are impossible to enforce fairly. The debate will keep growing as Congress looks for ways to manage the nation’s immigration enforcement rules.
