US Investigates Ilhan Omar Over Alleged Immigration Form Lies

A federal investigation is examining whether Rep. Ilhan Omar made false statements on her immigration paperwork, according to reports, as the Trump administration escalates its long-running feud with the Minnesota Democrat.

The investigation, confirmed by Department of Homeland Security officials, centers on allegations that Omar married her brother, Ahmed Nur Said Elmi, in 2009 to help him obtain legal immigration status in the United States. Omar has repeatedly and forcefully denied the allegation, calling it “absurd and offensive”.

The Allegations

Homeland Security Secretary Markwayne Mullin said in September that federal authorities are investigating Omar’s immigration history. “We know she married her brother to bring him to America,” Mullin said during an interview with conservative podcaster Benny Johnson.

Mullin suggested the investigation extends beyond the marriage itself, examining the entire family’s immigration process and whether Omar’s original entry into the United States involved other violations.

Vice President JD Vance said in March that he believed Omar “did commit immigration fraud against the United States”. President Trump has also publicly claimed Omar “married her brother,” calling it completely illegal.

The Legal Hurdles

Immigration attorney Michael Wildes told Fox News Digital that building a criminal case against Omar would face a “very high bar”.

“To succeed in proving marriage fraud, the government must prove beyond a reasonable doubt that the defendant knowingly entered into the marriage primarily for the purpose of evading immigration laws and obtaining related benefits,” Wildes said .

He added that even if Omar and her husband decided after the wedding to use the marriage to speed up his immigration process, a court would not necessarily find that to be marriage fraud. “They have to cross a very high threshold. The immigration benefit cannot just be a collateral consequence or secondary consideration; in that case, it is not considered illegal” .

Wildes also noted that the statute of limitations could be an obstacle, given the marriage took place in 2009.

The Denaturalization Question

Omar became a US citizen in 2000 at age 17, when her father was naturalized. The controversial marriage occurred nine years later. This distinction is significant: even if the marriage fraud allegation were proven, it was not the direct path to her citizenship.

However, if federal investigators can prove her father made false statements during the naturalization process, that could potentially be used to strip Omar of her citizenship. Former federal prosecutor Neama Rahmani told Newsweek that denaturalization is “a very serious proceeding”.

Wildes emphasized the difference between deliberate lies and innocent mistakes. “If the government files a case based on document fraud, we need to know whether she had legal representation and whether her application simply contained errors or omissions that were characterized as fraud”.

The Political Context

The investigation comes a month before the midterm elections and follows a federal search of Omar’s Washington, D.C. home in October. Critics have characterized the timing as political targeting.

“This kind of clearly motivated political targeting a month before the election should shock everyone, no matter what you think of Rep. Omar,” wrote Tanya Golash-Boza, a professor at the University of California, Merced.

Omar has been a frequent target of Trump’s attacks since entering Congress. The president has repeatedly called for her to be deported to Somalia.

The Bottom Line

Federal authorities are investigating whether Rep. Ilhan Omar made false statements on immigration forms, focusing on allegations that she married her brother in 2009 to help him obtain legal status. DHS Secretary Markwayne Mullin and Vice President JD Vance have publicly claimed Omar committed fraud. Omar denies the allegations. Legal experts say proving marriage fraud requires evidence that the marriage was entered into primarily for immigration purposes — a high bar — and the statute of limitations may complicate prosecution. The investigation is examining whether her father’s naturalization paperwork contained false statements, which could potentially lead to denaturalization.

My Opinion

Ilhan Omar has been accused of marrying her brother for immigration purposes for nearly a decade. She has denied it every time. The allegation has been investigated before. It has never resulted in charges. Now, a month before the midterm elections, the Trump administration says it is investigating again.

The timing is not at all subtle. DHS Secretary Markwayne Mullin went on a conservative podcast to announce the investigation. Vice President JD Vance said he believes Omar committed fraud. The president has called for her deportation. None of them have presented evidence. None of them have filed charges. They have just made the accusation, loudly, in public, before an election.

Maybe the allegation is true. Maybe Omar did something wrong in 2009, when she was 26 years old and navigating a complicated immigration system. But even if it is true, the statute of limitations has likely expired, and the marriage was not the path to her citizenship. She became a citizen at 17 through her father’s naturalization. The connection between the alleged fraud and her current status is tenuous at best.

What is not tenuous is the political motive. Omar is a Muslim woman, a Somali immigrant, and a vocal critic of the president. She is exactly the kind of target this administration has spent years going after. If the Justice Department has evidence, it should present it in court. If it does not, it should stop using the machinery of federal law enforcement to smear a political opponent.
