Watchdog Sues to Block Jared Kushner’s Role in Trump White House

A watchdog group filed a lawsuit Wednesday challenging the legality of Jared Kushner’s role in his father-in-law’s administration, arguing that his position violates the Constitution’s Appointments Clause.

“Primarily, this suit seeks to bar Kushner from occupying his government position and exercising government authority in violation of the Appointments Clause,” the lawsuit from Citizens for Responsibility and Ethics in Washington reads. “If not for this violation, Kushner would have been required to comply with transparency and conflict-of-interest obligations, including the filing of public financial disclosures during the appointment process.”

The Legal Argument

The Appointments Clause lets the president appoint “principal officers” that the Senate later confirms and allows courts or departments to appoint “inferior officers” with Congress’s permission. Kushner has not been confirmed by the Senate for his current government work.

In February, Trump said he was going to make Kushner a special envoy for peace. The president’s son-in-law returned to Trump’s second term to take part in specific talks, working toward a ceasefire between Israel and Hamas and crafting a Gaza peace plan for reconstruction and governance.

Watchdog Sues to Block Jared Kushner's Role in Trump White House

NewsNation, The Hill’s sister network, was later told by the White House that Kushner’s role was not official.

The Ambiguity

Kushner has worked with Steve Witkoff, a loyal Trump adviser whose role is special envoy for peace missions. Trump in February said Kushner would acquire the same title. “We’re making Jared also envoy of peace. They’re both envoys of peace,” Trump said at the time.

The White House has not clarified whether Kushner’s position is formal or informal, which is at the heart of the legal challenge. If Kushner is exercising government authority, CREW argues, he must be subject to the same appointment and disclosure requirements as other officials.

The Hill publications has at the time of making this report, reached out to the White House for comment on the suit.

The Bottom Line

A watchdog group is suing to block Jared Kushner from his role in the Trump administration, arguing that he was never Senate-confirmed and is violating the Appointments Clause. CREW says Kushner should be subject to transparency and conflict-of-interest requirements. The White House has said Kushner’s role is not official, but Trump called him an “envoy of peace.” The lawsuit seeks to bar Kushner from exercising government authority.

My Opinion

Jared Kushner is not a Senate-confirmed official. He has not filed public financial disclosures. He has not been subject to the conflict-of-interest rules that apply to everyone else in government. And yet he is reportedly helping craft a Gaza peace plan, negotiating a ceasefire between Israel and Hamas, and working alongside a special envoy with a formal title.

If Kushner is exercising government authority, he is violating the Constitution. If he is not, then what exactly is he doing? The White House cannot have it both ways. It cannot let Kushner act like an envoy when it is convenient and then call his role “unofficial” when someone asks about accountability.

There is a reason the Appointments Clause exists. It is not a technicality. It is a safeguard against exactly this kind of arrangement: a president’s family member wielding influence and power without the scrutiny, transparency, or oversight that applies to everyone else.
