A recent ruling by the High Court in Port Harcourt has cast a shadow over the legitimacy of the 27-member Martin Amaewhule-led Rivers State House of Assembly, as they have been restrained from functioning as lawmakers. This development stems from a lawsuit filed by Victor Oko Jumbo and two other lawmakers loyal to Governor Siminalayi Fubara, challenging the legitimacy of the assembly members who defected to the APC.

The court’s decision to issue an interlocutory injunction against the assembly members raises questions about the stability and functionality of the Rivers State House of Assembly. What Happened:

In a suit marked PHC/1512/CS/2024, Justice Charles Wali of the Rivers State High Court granted an interlocutory injunction, restraining the 1st to 25th defendants from acting as members of the Rivers State House of Assembly. The ruling also prohibits them from convening or conducting legislative business at the Auditorium of the House of Assembly Quarters or any other location.

Furthermore, the 26th to the 28th defendants are barred from engaging with the assembly members in their purported capacities as lawmakers. The court declared their legislative seats vacant effective from December 13th, 2023, pending the resolution of the substantive suit. The case has been adjourned to July 1st, 2024, for mention.
