Judicial Controversy in Kano LG Elections: CSO Calls for Presidential Action

The Citizens for Development and Education (CDE) has urged President Bola Tinubu to address the escalating controversy in Kano State regarding local government elections, emphasizing the importance of upholding the rule of law.

This call follows growing concerns about judicial integrity, particularly in cases related to local government (LG) elections. In Kano and several other states where LG elections are mandated, controversies have challenged the credibility of Nigeria’s judicial system.

Federal High Court Blocks LG Elections in Kano

The recent controversy stems from a Federal High Court ruling in Kano, where Justice Simon Amobeda issued a judgment blocking the Kano State Independent Electoral Commission (KANSIEC) from conducting local government elections. This decision contradicts an earlier ruling by the Supreme Court, which mandated that LG polls be held in Kano on October 26. CDE has condemned the ruling, calling it a threat to democracy and urging intervention to protect democratic processes in the state.

CDE Warns Against Undermining Democracy

The CDE, a coalition of civil society organizations, academics, democracy advocates, and entrepreneurs from Nigeria’s six geopolitical zones, expressed grave concern over the Federal High Court’s ruling. In a statement, CDE’s Executive Director, Ibrahim Waiya, criticized the decision as a direct threat to Nigeria’s democracy. “Mr. President, the action of a serving Federal High Court judge in Kano poses a great threat to our nation’s democracy. It is essential that the rule of law prevails for the survival of our democracy,” Waiya asserted.

Adding to the controversy, Justice Amobeda’s ruling was issued on an Islamic holiday, which CDE argued showed disregard for cultural sensitivities and intensified tensions in the state.

Judicial Independence and Integrity Under Scrutiny

The contradictory court rulings and delays in implementing the Supreme Court’s mandate for LG elections have cast doubt on the independence and integrity of Nigeria’s judicial system. The CDE warned that this breach of judicial order could set a dangerous precedent, where lower court rulings ignore higher courts, undermining the authority of the judiciary as the country’s highest legal institution.

The organization voiced its concern over what it perceives as judicial interference in the democratic process, warning that the judiciary’s role should be to uphold, not obstruct, democratic principles. “This ruling, which prevents Kano from conducting local government elections, undermines the will of the people and puts unnecessary pressure on the democratic institutions we have worked so hard to build,” Waiya stated.

Call for Accountability and Transparency

Highlighting the importance of accountability and transparency, the CDE emphasized the need for a judiciary that supports democracy and respects the rule of law. “It is crucial for the judiciary to act with fairness and uphold the rule of law, not just in Kano but across the country. The people deserve a judiciary that supports democracy, not one that hinders it,” Waiya concluded.

CDE’s Appeal to President Tinubu

As tensions between the judiciary and executive continue to rise in Kano, the CDE has appealed to President Tinubu to take immediate action to ensure that democratic principles are protected. The organization called on the government to address the issues raised and to guarantee that the Supreme Court’s directive to hold local government elections in Kano is respected, reinforcing Nigeria’s commitment to democracy.
