The federal government has issued new rules that increase scrutiny on green card applications, giving immigration officers wide freedom to deny permanent residency to individuals deemed likely to depend on public benefits. According to updated policy guidance released by U.S. Citizenship and Immigration Services (USCIS), officers will evaluate an applicant’s age, health, family status, financial resources, education, and skills to decide whether they pass the broader public charge test. The updated framework replaces the 2022 standards and allows reviewers to assess all relevant facts on a case-by-case basis. Officials emphasized that these changes fulfill federal law requiring non-citizens to remain self-sufficient.

The updated policy manual expands the scope of information immigration officers can examine when processing lawful permanent resident requests. For forms postmarked or submitted electronically, officers can weigh an applicant’s past or present use of means-tested public benefits. This includes housing assistance, food stamps, cash assistance, and college financial aid.

Reviewers may consider whether an applicant’s relatives or household dependents rely on public health or social service programs.

Evaluations will heavily focus on five specific areas: an individual’s age, health conditions, household size, overall assets or debt, and employment history. If an applicant is flagged solely on public charge grounds, USCIS or consular officials may invite them to post a financial guarantee or cash bond using Form I-945 before granting final approval. The public charge evaluation applies to most family-based and employment-based categories, but Congress continues to exempt refugees, asylees, human trafficking victims, and special immigrant juveniles.

Lawyers and advocacy groups urge individuals with pending filings to review financial documentation carefully to ensure their filings meet all income threshold standards.
