A federal judge has dealt a major blow to President Donald Trump’s controversial ban on transgender service members, indefinitely blocking the policy from taking effect.

US District Judge Ana Reyes, a Biden appointee, issued a scathing ruling, describing the ban as “soaked in animus and dripping with pretext.”

The transgender ban, which was set to take effect later this month, would have barred transgender individuals from serving in the military. Reyes’ decision marks a significant victory for LGBTQ+ advocates and transgender service members who have fought against the policy.

Judge Reyes’ Devastating Ruling

In her ruling, Judge Reyes criticized the ban as “unabashedly demeaning” and argued that it stigmatizes transgender individuals as inherently unfit for military service. She emphasized that the policy’s conclusions “bear no relation to fact” and highlighted the sacrifices made by transgender service members.

“Thousands of transgender service members have sacrificed—some risking their lives—to ensure for others the very equal protection rights the Military Ban seeks to deny them,” Reyes wrote.

The judge paused her preliminary injunction until Friday morning to allow the administration time to appeal the decision to the DC Circuit Court of Appeals.

Lawsuit Filed by Transgender Service Members

The ruling came in response to a lawsuit filed by transgender active-duty service members and individuals hoping to enlist in the military. The plaintiffs argued that the ban violated their constitutional rights, and Reyes agreed, stating that they were likely to succeed in their claim.

Trump’s ban, implemented via an executive order shortly after he took office, claimed that allowing transgender individuals to serve would negatively impact military readiness, lethality, and cohesion. However, Reyes rejected this argument, writing that the administration had failed to provide a legitimate reason for the ban.

Pentagon’s Guidance and Policy Details

In late 2023, the Pentagon released guidance implementing Trump’s ban, stating that transgender service members who did not meet specific requirements would be processed for separation. The policy memo declared that the Department of Defense only recognizes two sexes—male and female—and that service members must serve in accordance with their sex at birth.

A senior defense official revealed that approximately 4,240 service members across active-duty, reserve, and National Guard units have been diagnosed with gender dysphoria. Of these, around 1,000 have undergone gender-affirming surgery between 2014 and 2025.

Historical Context and Previous Legal Battles

This is not the first time Trump’s transgender military ban has faced legal challenges. During his first term, a similar 2017 ban was blocked by multiple federal courts, which ruled that it violated the constitutional rights of transgender individuals.

Although the Supreme Court allowed the ban to take effect in 2019, it did not rule on its constitutionality. President Joe Biden reversed the policy in 2021, but Trump’s attempt to reinstate it has reignited the legal battle.

The Reactions to the Ruling

Reyes’ decision was celebrated by LGBTQ+ advocates and the legal team representing the plaintiffs. Jennifer Levi, an attorney with GLAD Law, praised the ruling, stating, “Today’s decisive ruling speaks volumes. The Court’s unambiguous factual findings lay bare how this ban specifically targets and undermines our courageous service members who have committed themselves to defending our nation.”

The ruling has been hailed as a significant step toward equality and inclusion in the military, though the legal battle is expected to continue as the administration appeals the decision.

Judge Reyes’ ruling represents a major victory for transgender service members and advocates of LGBTQ+ rights. By blocking Trump’s ban, the court has reaffirmed the importance of equal protection and the right of all individuals to serve their country without discrimination.

As the case moves to the DC Circuit Court of Appeals, the fight for transgender rights in the military remains a critical issue, with far-reaching implications for equality and justice.
