Olalekan Onafeko, the suspended Clerk of the Lagos State House of Assembly has returned to his position following a court order. Onafeko was suspended on January 13, 2025, the same day Mudashiru Obasa was removed as Speaker by a 36-to-40 lawmaker vote.

Legal Challenge and Court Ruling

Onafeko challenged his indefinite suspension in the National Industrial Court (NIC). The NIC ruled in his favor, ordering his immediate reinstatement pending the final determination of his lawsuit against the Lagos State Government and other respondents. The court order explicitly mandated his return to duties pending the determination of the suit.

Onafeko’s Response and Claims of Wrongdoing

Upon his return to office, Onafeko addressed journalists. He asserted his legal right to the position, highlighting his four-year appointment in 2022 with the possibility of reappointment under the Lagos State House of Assembly Legislative Service Commission Law.

He expressed confusion at his suspension, claiming he received no prior notice or accusations of misconduct. He characterized his suspension as “illegality and legislative rascality.” He further stated that the court order had effectively nullified these actions.

Implications and Significance of the Ruling

Onafeko framed the court’s decision as a victory for justice and due process, emphasizing the judiciary’s role in protecting those facing oppression. He viewed the reinstatement as a triumph for the rule of law and the principles of a civil society.

In his words, “This is a victory for the rule of law and the ethos of a civil society. The court remains the last hope of the common man, including the oppressed.”

Conclusion

The reinstatement of Olalekan Onafeko marks a significant development in the ongoing power dynamics within the Lagos State House of Assembly. The court’s intervention underlines the importance of due process and the judiciary’s role in safeguarding individual rights, even within the context of political upheaval.

The ultimate resolution of Onafeko’s lawsuit will further clarify the legal implications of his suspension and the broader political context surrounding the events of January 13, 2025.
