Kanu seeks N100bn damages from FG for violating the court order

Mazi Nnamdi Kanu, the imprisoned leader of the Indigenous People of Biafra (IPOB), has filed a Fundamental Right Action before the Federal High Court in Abuja to seek payment of One Hundred Billion Naira (N100,000,000) as restitution for the Federal Government’s flagrant violation of his rights to liberty and the dignity of human beings.

The IPOB leader is also requesting an immediate release from the Department of State Services “illegal institution,” according to a statement by his legal team, which is led by Chief Mike Ozekhome (DSS).

The communique notes that the Federal Government of Nigeria’s continued grandstanding to implement/carry out the Court of Appeal’s Orders/Judgment, delivered on the 13th day of October 2022, effectively exonerated Mazi Nnamdi Kanu of the “frivolous” charge brought against him and, as a result, forbade the government from further detaining him and/or subjecting him to a trial or prosecution by any Nigerian court.

The legal team representing Kanu also contended that his “fundamental rights to personal liberty, the dignity of the human person, and freedom of movement” had been violated by his ongoing and unlawful incarceration from October 13, 2022, and as a result, it is illegal and unconstitutional.

The statement from Kanu’s legal team also stated that under Section 35 subsection (6) of the 1999 Constitution of the Federal Republic of Nigeria (As Amended) 2011, the applicant (Kanu) is constitutionally entitled to the payment of compensation and a public apology from the Respondents for the egregious violation of his rights to human dignity, personal liberty, and freedom.
