Newark Mayor Ras Baraka, the leader of New Jersey’s largest city, has been released following his arrest on Friday. The arrest occurred after Mayor Baraka allegedly attempted to gain entry into a migrant detention facility in Newark, sparking a confrontation with federal authorities.
Alina Habba, the acting US attorney for New Jersey, stated that Newark Mayor Ras Baraka “committed trespass and ignored multiple warnings” to leave Delaney Hall, a facility operated by Immigration and Customs Enforcement (ICE). Habba’s statement underscores the legal basis for the Newark mayor’s arrest during the migrant center protest.
Mayor Baraka was accompanied by three Democratic members of Congress during his visit to the ICE facility. These federal lawmakers were not arrested and stated their presence was part of an “oversight” effort to ensure the facility was adhering to building safety ordinances and not violating any local regulations concerning the migrant detention center.

Newark Mayor Baraka Denies Wrongdoing in Migrant Center Incident
In an interview with CNN, Newark Mayor Ras Baraka asserted that he did not violate any laws and was “exercising my right and duty as an elected official” by attempting to access the migrant detention facility. Despite his claims, Mayor Baraka has been charged with one count of trespassing following the incident at the ICE facility.
Meanwhile, a separate statement issued by the Department of Homeland Security (DHS) provided a contrasting account of the events. The DHS alleged that a group of protestors, which included the Democratic members of Congress, “stormed the gate and broke into the detention facility” while a bus transporting undocumented migrants was being brought inside the fenced perimeter of the migrant center.
The Department of Homeland Security statement further characterized the actions of the protesting lawmakers as going “beyond bizarre political stunt” and asserted that such actions “puts the safety of our law enforcement agents and the detainees at risk” within the migrant detention facility.
But Mayor Baraka countered the DHS account in his CNN interview, stating that he did not unlawfully enter the 1,000-bed facility. He explained that he was present for a news conference with the three members of Congress who had been granted entry into the migrant detention center.
As at the time of filing this report, New Jersey’s Democratic Governor. Phil Murphy has publicly stated that he was “outraged” by the arrest of Newark Mayor Ras Baraka during the protest at the migrant detention facility.
Following his arrest, Mayor Baraka was taken to a DHS detention center. Upon his release a few hours later, he addressed supporters who had gathered outside the facility, asserting, “We didn’t do anything wrong” in their attempt to gain access to the migrant center.
Newark Previously Filed Lawsuit Against Use of Migrant Detention Facility
Earlier in the year, the city of Newark filed a lawsuit seeking to block the operation of the Delaney Hall facility. This migrant detention center has become a point of contention regarding federal immigration enforcement policies.
City officials allege that the private firm contracted by ICE to operate the facility did not obtain the necessary permits and obstructed required inspections. The firm has stated to the media that they possess the proper permits, while the DHS maintains that all permits and inspections are up to date for the Newark migrant detention facility.
