What Israel stands to lose by disobeying ICJ demand

Wars are rarely fought alone; they often involve the support of allies and friends who provide various forms of assistance.

However, the state of israel is currently facing isolations in the international community due to its ongoing military offensive in Gaza. This isolation stems from Israel’s resistance to external pressure for a ceasefire especially in Rafah, which is currently experiencing a deteriorating humanitarian situation, resulting in criticism and the withdrawal of support from its allies.

Exacerbating the situation is the recent judgment given by the ICJ that now places the resistant state against international law. The International court of Justice (ICJ) has ordered Israel to stop its military offensive in the southern Gaza city of Rafah. This ruling opposes Israel’s objective of eliminating Hamas from Palestine.

Earlier this week, the chief prosecutor for the International Criminal Court requested arrest warrants for Benjamin Netanyahu and Yoav Gallant. Additionally, three European states announced they would formally recognize a Palestinian state. Now, the ICJ’s ruling adds further international pressure on Israel to halt its military actions.

Israel determined stance

Despite the ICJ’s order, Israel remains steadfast in its military objectives, setting itself against the principles guiding international relations. This defiance will likely lead to further isolation and withdrawal of allies from Isreal as standing with the nation could mean going against the whole world.

This juncture is crucial for Israel, as it will reveal its strongest allies and expose those who are merely “fair-weather friends.” Israel’s current position also places the United States in a difficult situation. The U.S., recognized as Israel’s strongest ally, now faces a dilemma of whether to support international law or stand by Israel. If Israel continues to ignore the ICJ’s demands, the matter could be referred to the Security Council for enforcement measures to compel compliance.

U.S Dilemma and Israel stance

This is a decisive moment for the U.S., which supported the ICJ against Russia two years ago when Russia ignored the court’s demands. Israel’s refusal to comply with the ICJ is rooted in its logical aim to eliminate Hamas for the safety of its citizens. Israeli Finance Minister Bezalel Smotrich responded to the judgement by stating, “Those who demand that the State of Israel stop the war, demand that it decree itself to cease to exist. We will not agree to that. If we lay down our weapons, the enemy will reach the beds of our children and women throughout the country.”

Israeli Chief Military Spokesperson Rear Admiral Daniel Hagari also noted, “Hamas is in Rafah, Hamas has been holding our hostages in Rafah, which is why our forces are manoeuvring in Rafah. We’re doing this in a targeted and precise way.”

Withdrawal seems to not be a course of action for Israel who have previously noted that they are willing to fight with just “fingernails” if they have to.

Future Implications

Israel appears determined to continue its military efforts, even at the cost of losing international allies. This determination raises several critical questions:

  • Will Israel be willing to sacrifice its alliances for this war against Hamas?
  • What are Israel’s chances of survival and victory if it loses its allies?
  • Will history repeat itself, and will the outcome be in Israel’s favor?

Bottom Line

Israel’s decision to defy the ICJ and continue its military operations in Gaza puts it at odds with the international community and risks further isolation.

The support of its allies, particularly the United States, is now uncertain, and Israel must weigh the potential consequences of its actions. The coming days will reveal whether Israel can maintain its strategic objectives while navigating the complex landscape of international diplomacy and law.
