Texas Supreme Court Backs Ban on Transgender Medical Care for Minors

The Texas Supreme Court has upheld a law that bars medical professionals from providing gender-affirming treatment to minors. This law, which includes banning puberty blockers, hormones, and other medical interventions aimed at helping transgender youth, came into effect on September 1, 2023, after being signed by Republican Governor Greg Abbott in June 2023.

Opponents, including parents, healthcare providers, and advocacy groups, immediately challenged the law, arguing it violated the Texas Constitution. A lower court judge agreed, issuing an injunction to halt its enforcement. However, the Texas Supreme Court overturned this decision, declaring the law constitutional and permitting its enforcement.

In the majority opinion, Justice Rebeca Huddle acknowledged that while parents have substantial rights to make healthcare decisions for their children, these rights are not without limits. “The legislature has the authority to regulate medical practices,” she stated, especially in instances where parental decisions might clash with the state’s interests.

Huddle emphasized that the legislature’s choice to restrict certain medical procedures for children was a “permissible, rational policy decision,” given the relative novelty of both gender dysphoria and its treatments.
