A Federal High Court in FCT, Abuja has rejected the preliminary objection filed by the National Youth Service Corp, NYSC, against Enugu State Governor, Peter Mbah’s N20 billion suit over alleged certificate forgery.
Justice Inyang Ekwo, had in a ruling on Friday July 28, held that the introductory objection lacked credit and should be dismissed.
Ekwo had insisted that the provision of Section 20 of the NYSC Act, 2004 which the Corps had based its objection on was not applicable to the governor since he was not a serving corps member.
In Ekwo’s words:
“Once again, I am inclined to agree with the plaintiff (Governor Mbah) on whom the provision of Section 20 of the NYSC Act, 2004 applies.”
This essentially means that the NYSC provision act has a set of persons to whom it is only pertinent to.
Ekwo, had thereafter, adjourned the matter until September 21 and September 22 for hearing, according to NAN.
