​According to police records from Brockton, Massachusetts, the charge stemmed from a September 2021 incident after the juror’s 13-year-old nephew called 911 following an argument between the juror and his wife. The foreperson noted that the lone holdout admitted to having reasonable doubt regarding Clancy’s intent but refused to join an acquittal based on mental illness.

​A prior arrest record does not automatically disqualify a citizen from serving on a jury, but any intentional non-disclosure during jury selection can compromise court proceedings.

​From a procedural standpoint, the discovery of the juror’s prior charge creates a complex dynamic for both the prosecution and the defense: If evidence suggests the juror purposefully concealed criminal history during selection, the court could initiate a formal inquiry into jury tampering or misrepresentation.

​ Defense attorney Kevin Reddington indicated plans to move for dismissal on double jeopardy grounds at an upcoming status hearing on September 29, 2026. The Plymouth County District Attorney’s Office has not yet announced whether it will retry the case or seek an alternative resolution.
