The recent legal battle between Elon Musk’s renowned carmaker, Tesla Inc., and Indian battery manufacturer Tesla Power India Pvt Ltd has sparked discussions regarding trademark infringement and consumer confusion.

Background:

Tesla Inc., based in Delaware, USA, has garnered acclaim for its innovative contributions to the energy storage industry, particularly with its affordable and long-lasting batteries. Meanwhile, Tesla Power India Pvt Ltd, an Indian company established in 2020, specializes in producing lead-acid batteries for conventional vehicles and inverters.

Despite operating in distinct segments of the battery market, Tesla Power finds itself embroiled in a legal dispute with Tesla Inc. over the alleged unauthorized use of the trademark “Tesla Power.”

Legal Proceedings:

Elon Musk’s Tesla Inc. initiated legal action against Tesla Power in the Delhi High Court, seeking damages and a permanent injunction against the Indian company. The crux of Tesla Inc.’s argument lies in the assertion that Tesla Power’s use of the trademark in India has led to consumer confusion and is detrimental to its business interests. Complaints directed at Tesla Inc. regarding Tesla Power’s products further exacerbate the situation, as consumers mistakenly associate the two entities.

Court Rulings:

In response to Tesla Inc.’s plea, the Delhi High Court issued a notice to Tesla Power, temporarily restraining the company from featuring promotional advertisements that could exacerbate consumer confusion until the next hearing on May 22. Tesla Power defended its position by clarifying that it primarily deals with lead-acid batteries, not electric vehicle (EV) batteries. Moreover, the court examined evidence suggesting that Tesla Power USA LLC, also based in Delaware, had a significant presence in India prior to Musk’s Tesla.

The Tesla v Tesla trademark dispute underscores the complexities of intellectual property rights in the global market. While Tesla Inc. seeks to protect its brand reputation and prevent consumer confusion, Tesla Power maintains its innocence, emphasizing its distinct market segment and prior establishment in India.
