The regulatory agenda item aims to reverse the 2015 policy that allowed eligible H-4 dependent spouses to obtain Employment Authorization Documents (EADs) while waiting for green card processing. While online commentators and activists have heavily debated the immediate impact of the announcement, immigration experts emphasize that the item is currently designated as a long-term agency proposal, meaning no immediate changes have been implemented.

​The announcement surrounding the H-4 work permit rule serves as an initial statement of regulatory intent rather than an enforceable law. Before any restriction can take effect, DHS must formally publish a Notice of Proposed Rulemaking (NPRM), open a public comment window, review feedback, and issue a finalized rule with a designated effective date, a process that typically spans many months.

Furthermore, legal analysts anticipate that any finalized rule attempting to revoke existing work authorization will face immediate court challenges.

​Recommendations for H-1B Spouses Amid Regulatory Talks

​Uncertainty over the H-4 work permit rule makes early planning essential for impacted families. Immigration attorneys advise current EAD holders to file renewal applications as early as permitted, up to 180 days prior to expiration, especially given the absence of automatic extension protections for certain categories. Spouses are also encouraged to explore independent visa pathways, such as individual H-1B, O-1, or National Interest Waiver options, to ensure long-term work authorization.

​My Opinion

​Stripping work authorization from H-4 visa holders is a counterproductive policy that harms skilled immigrant families and damages economic competitiveness.
​

The individuals using H-4 work permits are overwhelmingly highly educated professionals, engineers, medical workers, researchers, and entrepreneurs—who contribute directly to local economies and pay taxes. Forcing talented individuals to abandon their careers simply because they accompanied a spouse on an H-1B visa creates severe financial stress for families and limits workforce potential.

​Beyond the immediate financial toll, eliminating the right to work makes the United States a far less attractive destination for international talent. Top-tier professionals will simply choose countries with flexible dual-career policies, such as Canada, the UK, or Australia. The Department of Homeland Security should abandon this proposal and focus on modernizing immigration processing rather than adding barriers for families already legally residing in the country.
