The National Broadcasting Commission on Friday, May 12 announced that it had yet to see the order of perpetual injunction restraining it from charging fines on broadcast stations in the country, saying that the order would be appealed.
The commission had said that this appeal was a necessary one if found to conflict with previous judgment, Justice James Omotosho, a judge of Federal the High Court in Abuja had in a judgment held that as they were not a law court the NBC had no power to impose sanctions as punishment on broadcast stations in Nigeria.
Justice Omotosho had sided with the plaintiff that the Nigeria Broadcasting Code being a subsidiary legislation that empowers an administrative body such as the NBC to enforce its provisions, could not confer judicial powers on the commission to impose criminal sanctions or penalties like fines.
