Supreme Court Appeal: Lagos State Challenges Overturned Conviction of Dr. Femi Olaleye

The Lagos State Government has announced its decision to challenge the Appeal Court’s ruling that overturned the conviction of Dr. Femi Olaleye, a medical practitioner accused of defiling his wife’s niece. The Babajide Sanwo-Olu-led administration is taking the matter to the Supreme Court in an effort to potentially reverse the appellate court’s decision.

This development follows the decision of the Court of Appeal sitting in Lagos, which voided Dr. Olaleye’s rape conviction, ruling that the lower court had erred in its judgment. On Friday, the appellate court discharged and acquitted Olaleye, citing “tainted” and “unreliable” evidence presented by the prosecution.

Earlier, in October, the special offences and domestic violence court in Lagos had convicted Olaleye on a two-count charge of defilement of a child and sexual assault by penetration. Justice Rahman Oshodi had sentenced Olaleye to life imprisonment based on the evidence provided by the Lagos State Government. The new ruling by the Court of Appeal has now drawn public scrutiny and concern over the integrity of the legal process.

Civil Rights Groups Demand Action
Civil rights groups have petitioned Lagos State Attorney General Lawal Pedro, SAN, urging him to appeal to the Supreme Court. These groups argue that overturning the conviction undermines public trust in the justice system, especially in cases involving sexual and child abuse. They have emphasized the importance of ensuring justice for vulnerable members of society.

The Lagos State Government’s move to appeal the case at the Supreme Court underscores its commitment to upholding justice and protecting the rights of children and survivors of abuse.
